Abstract:

Legal Framework of Renewable Energy A Comparative Study In light of the Arab, European and American Laws The law plays an important role in promoting the use of renewable energy and prosperity of the national economy through a range of economic incentives such as: exemption from (or reduction of) customs duties and taxes for the techniques and projects of renewable energywith increasing of customstaxes on traditional energy. This provides competitive prices and reasonable profit for investors in this important field. In addition, they may use of renewable energy certificates and apply of the system of increasing the share of renewable energy. The renewable energy needsto a range of complex and coherent contracts to regulate the exploitation, management and development of sources and investments such as: contracts for the purchase of renewable energy, energy performance contracts and model contracts for leasing renewable energy. These contracts impose restrictions and new contractual rights and obligations on its parties. Although the importance of these contracts, the legal uncertainty still surrounds their organization. This requires the formulation of model contracts specify precisely the obligations of the parties, and include common and unified rules for trading in renewable energy, and to balance financial and legal security for the parties to the contract, taking into account the accurate regulation and good drafting and developing fair conditions, to reduce the problems associated with the implementation of these long-term contracts. The widespread use of renewable energy led to the emergence of legal principles exciting and innovative to overcome the shortcomings of the current legal regime on easements renewable energy, which vary to: solareasements; and easements wind energy; and easements transmission lines renewable energy that will facilitate the establishment of smart grids cross of the border. Despite the importance of these rights, the laws of the Arab countries do not organize them by special rules.
